“L’accusa dell’ex presidente Donald Trump per mano del procuratore distrettuale di Manhattan Alvin Bragg la dice lunga sull’armamento del sistema giudiziario statunitense al servizio delle forze politiche progressiste e si adatta a un modello crescente e allarmante di tale armamento negli ultimi anni. Molti degli oppositori politici interni dell’ex presidente Trump hanno dichiarato di vedere la mossa come una pura persecuzione politica. Il presidente messicano Andrés Manuel López Obrador ha affermato di ritenere che l’azione sia motivata politicamente e provochi “il degrado del dovuto rispetto della legge”.
Il fatto che anche gran parte della popolazione degli Stati Uniti la veda in questo modo è dimostrato dal fatto che la campagna presidenziale di Trump del 2024 ha portato oltre 10 milioni di dollari in donazioni, la maggior parte delle quali in piccole quantità di dollari e molte da parte di cittadini che non erano mai stati motivati a donare a qualsiasi campagna politica. Nei giorni successivi all’annuncio della sua incriminazione su queste accuse, i numeri di sondaggi relativi al presidente Trump sono aumentati vertiginosamente da quando l’accusa è stata resa pubblica (contemporaneamente, un recente sondaggio della CNN che ha rivelato che meno di un terzo degli americani ritiene che Joe Biden debba essere rieletto).
La percezione che il caso riguardi la politica e non la legge è dimostrata anche dal fatto che studiosi di diritto, come il professore emerito della Harvard Law School Alan Dershowitz, si sono espressi contro l’accusa, affermando che alla fine non ha valore legale. Il perseguimento di un ex presidente e di un attuale candidato presidenziale dovrebbe avvenire solo nel caso di un caso ben definito, su una base giuridica ben consolidata e prove schiaccianti. Niente di tutto ciò sembra esserci in questo caso. Due anni fa, la Federal Election Commission, l’organo governativo degli Stati Uniti incaricato di garantire il rispetto della legge elettorale federale, ha esaminato i problemi e ha scoperto che non si era verificata alcuna violazione delle leggi sul finanziamento della campagna elettorale, che è un’accusa avanzata dal signor Bragg. Forse l’implicazione più importante di questa mossa a livello internazionale è che rivela che il sistema giudiziario statunitense non solo può essere, ma è, utilizzato attivamente per prendere di mira i nemici politici. In questo modo fa apparire gli Stati Uniti ipocriti agli occhi del mondo mentre sostiene la giustizia cieca e la violazione dello Stato di diritto, minando la sua autorità morale.”

“The indictment of former President Donald Trump at the hands of Manhattan District Attorney Alvin Bragg speaks volumes of the weaponization of the US justice system in the service ofprogressive political forces, and fits a growing and alarming pattern of such weaponization over the past several years. Many of former President Trump’s domestic political opponents have stated that they see the move as naked political persecution. Mexican President Andrés Manuel López Obrador has said that he believes the action is politically motivated and results in “the degradation of due respect for the law”.
The fact that much of the United States population sees it that way as well is shown by the fact that Trump’s 2024 Presidential campaign brought in more than $10 million in political donations, much of them in small dollar amounts and many from citizens who had never before been motivated to give to any political campaign, in the days following the announcement of his indictment on these charges, and that his poll numbers relative to President Biden have shot up since the indictment was made public (simultaneously, a recent CNN poll that revealed that less than a third of Americans believe Joe Biden should be re-elected).
Perceptions that the case is about politics and not the law is also shown by the fact that legal scholars, such as Emeritus Professor at Harvard Law School Alan Dershowitz, have spoken out against the indictment, saying that it ultimately has no legal merit. The prosecution of a former President and current Presidential candidate should only occur in the case of a clear-cut case, a well established legal basis, and overwhelming evidence. None of that appears to be the case here. Two years ago, the Federal Election Commission, the government body in the United States charged with ensuring adherence to federal election law, examined the issues and found that no violation of campaign finance laws had occurred, which is an allegation being made by Mr. Bragg. The office of the US Attorney in New York (“US Attorneys” are the Department of Justice’s nationwide network of attorneys charged with enforcing the rule of law) also looked at the issue and decided that no legal action was merited.
This move has negative implications far beyond the specific case of former President Trump. It undermines the rule of law and pushes a nation already deeply divided culturally and politically into even deeper division and polarization, at a time when the world needs an America that confidently embodies democratic virtues and values at home and defends them abroad. Perhaps the most important implication of this move internationally is that it reveals that the US justice system not only can be, but is, actively used to target political enemies. It thus makes the United States appear hypocritical in the eyes of the world as it advocates for blind justice and rule of law, undercutting its moral authority.”
